Terms and Conditions

1. Introduction

These Terms & Conditions (“Terms”) govern the use of Infomatix’s services and products.

By booking, purchasing, or using our services, you agree to be bound by these Terms and by applicable Australian law, including the Australian Consumer Law (ACL).

Infomatix Pty Ltd (“we”, “our”, “us”, “Infomatix”, “Infomatix IT Solutions”) provides IT support, consultancy, project services, and professional services to businesses, individuals, and TTAC & NDIS Plan Managers and self-managed participants. We also sell devices, computer hardware, software, and subscriptions.

2. Services

· IT Support: Charged by the hour, available onsite or remotely.

· Consultancy & Professional Services: Tailored advice and solutions for businesses, individuals, and NDIS participants.

· Project Services: Delivery of scoped IT projects, including planning, implementation, and ongoing support. Project services are subject to written proposals and acceptance by both parties.

· Products: Devices, computer hardware, software, and subscriptions are listed on our website and available for online purchase.

· Bookings: Customers can book and pay for services online via www.infomatix.com.au.

3. Pricing & Payment

Prices are listed in Australian dollars (AUD) and include GST where applicable.

Payment is required at the time of booking or purchase unless otherwise agreed in writing.

Accepted payment methods are those displayed on our website.

Hourly rates apply to IT support services; project services are billed in accordance with agreed proposals.

Product sales (devices, hardware, software, subscriptions) must be paid in full at the time of order unless otherwise agreed.

4. Delivery & Ownership

Services: Delivered onsite or remotely as agreed.

Products: Shipped or delivered as per order confirmation. Delivery times are estimates only.

Ownership: Title to products passes to the customer once full payment is received. Risk passes on delivery.

Subscriptions: Access to software or services is subject to the terms of the relevant vendor or provider.

5. Cancellations & Refunds

Services: Cancellations must be made at least 24 hours before the scheduled service. Late cancellations may incur a fee.

Products: Refunds or replacements are provided in accordance with the ACL. Customers are entitled to remedies if products are faulty, not fit for purpose, or do not match their description.

Change-of-mind refunds: Not offered unless required by law.

Project Services: Deposits or milestone payments may be non-refundable once work has commenced, except where required under the ACL.

6. Returns Policy

Australian Consumer Law Compliance: Our returns policy operates in accordance with the ACL. You are entitled to a replacement, repair, or refund if products or services fail to meet consumer guarantees.

Products (Devices, Hardware, Software, Subscriptions):

· Returns are accepted if the product is faulty, defective, or not as described.

· Software and subscriptions cannot be returned once activated, except where required under the ACL.

· Products must be returned in their original condition with proof of purchase.

Services:

· If services are not delivered with due care and skill, or are not fit for purpose, you are entitled to remedies under the ACL.

· Refunds for services will not be provided for change-of-mind cancellations once delivery has commenced.

Process:

· Customers are responsible for returning products safely and securely.

· Refunds will be processed using the original payment method within a reasonable timeframe.

7. NDIS & TAC Services

Infomatix IT Solutions provides services to TAC, NDIS Plan Managers and self-managed participants.

· Services will be invoiced in compliance with TAC/NDIS billing requirements.

· Participants are responsible for ensuring their plan covers the requested services.

8. Customer Responsibilities

Provide accurate information when booking or purchasing services or products.

Ensure access to premises, systems, and equipment necessary for service delivery.

Maintain appropriate backups and security of data prior to service delivery.

Comply with all applicable laws and regulations when using our services and products.

9. Limitation of Liability

To the maximum extent permitted by law, Infomatix IT Solutions is not liable for indirect, incidental, or consequential loss arising from the use of our services or products.

Our liability is limited to the resupply of services or the cost of resupply, or replacement/repair of products, as permitted under the ACL.

Nothing in these Terms excludes your rights under the ACL.

10. Intellectual Property

All content, materials, and documentation provided by Infomatix IT Solutions remain our intellectual property unless otherwise agreed.

Customers may use materials solely for their internal business or personal purposes.

Software and subscriptions are subject to licensing terms of the relevant vendor.

11. Privacy & Data Protection

We handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.

By using our services, you consent to the collection and use of your information as outlined in our Privacy Policy.

12. Website Use

www.infomatix.com.au may contain links, product listings, and booking systems.

You must not misuse the website, attempt unauthorised access, or engage in fraudulent activity.

We reserve the right to modify or withdraw website content at any time.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia.

Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

14. Amendments

Infomatix IT Solutions may update these Terms from time to time.

Updated Terms will be published on www.infomatix.com.au and apply from the date of publication.
